Terms of Service

These Terms of Service ("Terms") govern your use of the Backpackers Friend mobile application and the website at backpackersfriend.app (together, the "Service"), published by Gabriel Mullen, an individual developer ("we", "us", or "the Developer"). Please read them carefully. By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Read this first — safety. Backpackers Friend is a planning and navigation aid, not a safety, emergency, or lifesaving device. It cannot summon rescue. Backcountry travel is inherently dangerous and can result in serious injury or death. You use the Service entirely at your own risk. See Section 5 for the full safety notice and assumption of risk.

1. Eligibility

You must be at least 13 years old to use the Service, and old enough to form a binding contract (or have the consent of a parent or legal guardian). If you use the Service on behalf of a minor, you accept these Terms on their behalf and are responsible for their use.

2. License to use the app

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use the app on Apple devices that you own or control, for your own non-commercial use. You may not copy, modify, reverse-engineer, decompile, rent, lease, sublicense, sell, or otherwise exploit the Service except as expressly permitted by these Terms or applicable law.

3. Subscriptions, free trials, and purchases

Some features require a paid subscription ("Premium"). Subscriptions are sold as auto-renewing in-app purchases and are billed through your Apple App Store account.

4. Your responsibilities

You agree to use the Service lawfully and responsibly. You are solely responsible for your own trip planning, preparation, fitness, equipment, and decisions in the field, and for carrying appropriate navigation tools (such as a paper map and compass) and emergency equipment. You agree not to misuse the Service, interfere with its operation, or use it in any way that could endanger yourself or others.

5. Safety notice and assumption of risk

This is the most important part of these Terms.

6. Disclaimer of warranties

The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, accurate, or that it will meet your requirements.

7. Limitation of liability

To the fullest extent permitted by law, in no event will the Developer be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or for personal injury, death, or property damage, arising out of or relating to your use of (or inability to use) the Service or your reliance on any information it provides, even if advised of the possibility of such damages. To the maximum extent permitted by law, the Developer's total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid for the Service in the twelve (12) months before the claim, or (b) ten U.S. dollars ($10). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

8. Indemnification

You agree to indemnify and hold harmless the Developer from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party or any law.

9. Third-party data and services

The Service displays and relies on data from third parties, including map tiles from OpenStreetMap (© OpenStreetMap contributors) and the U.S. Geological Survey, and uses Apple and RevenueCat for purchases. We do not control and are not responsible for the accuracy, availability, or practices of third-party data or services, and their use may be subject to their own terms.

10. Intellectual property

The Service, including its software, design, text, graphics, and logos, is owned by the Developer or its licensors and is protected by intellectual-property laws. Except for the limited license granted above, no rights are transferred to you. Third-party data displayed in the app remains the property of its respective owners and is used under their licenses.

11. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how information is handled (in short: on-device, with no accounts and no analytics).

12. Termination

You may stop using the Service at any time and may delete the app. We may suspend or terminate your access to the Service if you violate these Terms or if necessary to comply with law or protect the Service. Sections that by their nature should survive termination (including Sections 5 through 10, 14, and 15) will survive.

13. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and post the new version here. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

14. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in California, and you consent to personal jurisdiction and venue there. Nothing in this section limits any non-waivable consumer-protection rights you may have under the laws of your place of residence.

15. General

These Terms, together with the Privacy Policy, are the entire agreement between you and the Developer regarding the Service. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a transfer of the Service. These Terms are between you and the Developer only, not with Apple; Apple is not responsible for the Service or for any claims relating to it, and Apple is a third-party beneficiary of these Terms with the right to enforce them.
